O R D E R

% 04.03.2025 By way of the present petition filed under section 438 of the Code of Criminal Procedure 1973, the petitioner seeks anticipatory bail in case FIR No.457/2023 dated 31.10.2023 registered under sections 498-A/406/354-A/377/34 of the Indian Penal Code, 1860 at P.S.: Prashant Vihar, Delhi.

Notice on this petition was issued on 21.12.2023, on which date interim protection from arrest was also granted to the petitioner. 3.

Petitioner is stated to be the brother-in-law of the complainant. 4.

Learned counsel appearing for the petitioner points-out, that further to what was recorded in order dated 05.08.2024, the parties have resolved the matter amicably through mediation; that Settlement Agreement dated 11.11.2024 has been signed between the parties; and the parties are at present acting upon the terms of the settlement. Counsel submits that in the circumstances, the interim protection granted to the petitioner vide order dated 21.12.2023 may be confirmed; and the petitioner may be granted anticipatory bail. 6.

Mr. Digam Singh Dagar, learned APP appearing on behalf of the State, on instructions of the Investigating Officer ('I.O.'), who is present in court, submits that in view of the settlement arrived-at between the parties, the I.O. is not proceeding further with the investigation; and does not require the custodial interrogation of the petitioner. 7.

In the circumstances, learned APP leaves it to the court to pass appropriate orders.

Considering the settlement arrived at between the parties and the fact that the I.O. does not require the custodial interrogation of the petitioner, this court is inclined to allow the present petition for anticipatory bail, thereby directing that in the event of his arrest, the petitioner shall be admitted to bail by the Investigating Officer/Arresting Officer subject to the following conditions: 8.1. The petitioner shall furnish a personal bond in the sum of Rs.25,000/- (Rs. Twenty-five Thousand Only) with 01 surety in the like amount from a family member to the satisfaction of the Investigating Officer/Arresting Officer;

8.2. The petitioner shall furnish to the Investigating Officer a cellphone number on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switchedon at all times; The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

8.3. If the petitioner has a passport, he shall surrender the same to the Investigating Officer and shall not travel out of the country without prior permission of this court;

8.4. The petitioner shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The petitioner shall not tamper with evidence nor otherwise indulge in any act or omission that is unlawful or that would prejudice the proceedings in the pending trial.

The petition stands disposed-of in the above terms.
