% 29.08.2024 The instant petition under Article 226 of the Constitution of India has been filed on behalf of the petitioner seeking the following reliefs: "a) issue writ, order, or direction in the nature of mandamus or any other writ directing respondent No.1 / Ramjas Public Sr Sec School (Day Boarding) Street No-10, Anand Parbat, New Delhi-110005 to grant admission to petitioner, namely, Satya in 1st Class under EWS category in academic year 2024- 2025; and b) issue writ, order, or direction in the nature of mandamus or any other writ directing the respondent No.2 Department of Education to take action against the respondent No.
1 / Ramjas Public Sr Sec School (Day Boarding) for its failure to not grant admission to petitioner in 1st class under EWS category in academic year 2024-25 under the provisions of the Delhi School Education Act, 1973;and c) Further issue writ, order or direction in the nature of mandamus/ certiorari or any other writ ,direction thereby directing the respondents to compensate the petitioner for Rs10,00,000/- (Rupees ten Lakhs Only) for causing unnecessary The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
harassment, mental pain, agony to the petitioner. d) Further impose cost on respondents."
Learned counsel appearing on behalf of the respondent no.1/school, on instructions, submitted that the admission in class KG shall be given to the petitioner in EWS category, subject to fulfilling the criteria of EWS category.
At this juncture, learned counsel appearing on behalf of the petitioner submitted that since the learned counsel appearing on behalf of the respondent no. 1/school has given an undertaking to give admission to the petitioner in the category of EWS category in class KG, nothing is left for further adjudication in the instant petition and therefore, the same may be disposed of, in terms of the above said undertaking given by the learned counsel appearing on behalf of the respondent no.1/school. Heard the learned counsel appearing on behalf of the parties. Since the learned counsel appearing on behalf of the respondent no.1/school has given an undertaking, on instructions, that the petitioner shall be admitted to class KG in the category of EWS, nothing is left for any further adjudication.
In view of the aforesaid undertaking, the instant petition stands disposed of along with the pending application(s), if any. Learned counsel appearing on behalf of the respondent no.1/school prayed that direction may be passed that this order should not be treated as a precedent. The said prayer is allowed and it is held that this order shall not be treated as a precedent.
