An application under Section 483 & 523 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for grant of interim bail in FIR No. 0292/2024 under Sections 21/29 of NDPS Act registered at P.S. Bhalswa Dairy on the ground that wife of the petitioner is required to undertake surgery. 2.

Learned counsel for the petitioner submits that surgery of wife could not be undertaken on 09.09.2024 due to shortage of funds and the presence of petitioner is required for purpose of arranging the funds. However, it is admitted that there are two sons and a daughter of petitioner who are major. 3.

On the other hand, learned APP for State vehemently opposes the application and submits that 400 grams of Heroin was recovered from possession of petitioner who is also previously involved in five NDPS cases. Considering the facts and circumstances of the case, previous involvement of petitioner in five cases coupled with the fact that surgery has not been undertaken by the wife of the petitioner on date scheduled, no grounds for interim bail are made out.

Application is accordingly dismissed. Pending applications, if any, also stand disposed of.
