By way of the present petition, the petitioner, who is complainant in CC No. 1911/2021, seeks to assail the impugned order dated 14.10.2023 passed by learned M.M. (NI Act), Digital Court-01, PHC, New Delhi vide which petitioner's application filed under Section 311 Cr.P.C. seeking to summon her husband namely, Sunil Kumar Yadav was dismissed. 2.
Learned counsel for the petitioner states that the respondent No.2/accused has given his no objection to the said application and the matter is still at the stage of recording of statement of accused. 3.
Learned counsel for respondent No.2 states that, with a view to have a speedy trial, he still has no objection to the present petition being allowed. 4.
Considering the aforesaid, present petition is allowed and petitioner will take immediate steps to summon aforesaid witness/Sunil Kumar Yadav, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. who shall also be cross-examined at the earliest, subject to payment of Rs.5,000/- to be paid by the petitioner to respondent No.2 within two weeks. 5.
