O R D E R

By way of present bail application, the applicant seeks regular bail in FIR No. 332/2024 registered under Section 109(2) BNS 2023, at P.S. Mahendra Park, Delhi.

Learned counsel for the applicant states that the applicant has been in custody since 19.07.2024. She contends that it was the complainant who was troubling the applicant's 12 years old nephew and that the applicant only went to save him. She further submits that the applicant is not the assailant and after the incident, the complainant's side also came to assault the applicant's family and even gunshots were fired, as a result of which, the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. FIR No. 333/2024 was registered under Sections 125/3(5) BNS 2023 and Sections 25/27 Arms Act, at P.S. Mahendra Park, Delhi, by the applicant's sister. She also submits that the applicant has no previous involvements whereas the injured has many prior involvements, however, he is taking advantage of being juvenile.

The application is vehemently opposed by the learned APP for the State who submits that the incident occurred on 19.07.2024 at about 12.55 am. The FIR is registered at the behest of the injured who stated that the applicant is involved in asking for money (Rangdari) at the Mandi from the vendors and on the day of the incident, had come to the vegetables cart of the injured and stated that as the injured/complainant's father was not paying the Rangdari, he would teach them a lesson. Thereafter, the applicant inflicted a knife blow in the stomach of the injured/complainant, which remained entangled and the injured/complainant was taken to Max Hospital, Shalimar Bagh in the same position, where the doctors took out the knife from his stomach. Subsequently, the injured was taken to BJRM Hospital, from where he was referred to Higher Centre at Lok Nayak Hospital. It is also submitted that the said injuries have been opined to be grievous in nature.

Considering the nature of the allegations and the period of custody, I am not inclined to admit the applicant on bail and consequently, the bail application is dismissed.
