The Petition under Section 482 CrPC has been filed on behalf of the petitioner for quashing the Complaint Case NO. 12667/2018 for the offence under Section 138 read with Section 141/142 of NI Act, 1881 and the summoning order dated 19.04.2018, passed by the learned Metropolitan Magistrate, NI Act, South West District Dwarka, Delhi. 4.
Essentially, the petitioner has been summoned in the Complaint Case No. 12667/2018 under Section 138 of N.I. Act vide Order dated 19.04.2018, by learned Metropolitan Magistrate. The petitioner had an alternative remedy of challenging it before the revisional Court, before the learned Sessions Judge. Moreover, the Petition suffers from delay and laches and it is, therefore, dismissed. 6.
The Petition is disposed of accordingly. The pending application also stands disposed of.
