The present appeal has been filed under Section 10 of the Delhi High Court Act, 1966 read with Section 151 of the Code of Civil Procedure, 1908, assailing the Order dated 22.03.2023, passed by the learned Single Judge, whereby the appellant's application under Order VII Rule 11 was dismissed. 2.

After addressing some arguments, learned counsel for the appellant prays to withdraw the present appeal with liberty to raise the issues on merits in the testamentary case at appropriate stage, in accordance with law. 3.

Accordingly, the present appeal stands disposed of as withdrawn, with the liberty as prayed for, in accordance with law. 4.
