Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for partquashing of FIR No. 404/2023 under Sections 308/323/341/34 IPC Act registered at P.S.: Amar Colony and proceedings emanating therefrom. 2.

Learned APP for the State appears on advance notice. 3.

Since present petition has been preferred only on behalf of one of the accused, learned counsel for petitioner, on instructions, seeks to withdraw the petition with liberty to file the same afresh in case the settlement is arrived at with other accused.
