In view of the fact that the aforementioned suit is a commercial suit under the definition of Section 2(1)(c)(vii) of the Commercial Courts Act, 2015, this Court finds that the aforenoted commercial suit pending in the Court of Additional District Judge-02, New Delhi District, Patiala House Courts, deserves to be transferred to the competent Commercial Court 2.

The parties also consent for transfer of the case to the Commercial Court.

The Court, therefore, deems it appropriate to transfer the Civil Suit bearing CS. No. 200/2021 titled Vikas Virmani & Ors v. M/s Avanta Business Centre Pvt. Ltd. & Ors to the Commercial Court, Patiala House Courts, New Delhi 4.
