O R D E R

% 27.02.2018 After some hearing, the counsel for the petitioner submits that he may be allowed to withdraw the present petition and the application filed therewith as the petitioner being the plaintiff of the case intends to move an application for amendment of plaint under Order VI Rule 17 CPC, inter alia, to bring in averments and also seek necessary reliefs about the assets other than of immovable property as well and the Will statedly left behind by Sushila Bhatia at the time of her death. He submits that in the proposed amendments, suitable prayer would be made for necessary correction in the valuation, though the petitioner also reserves the right to seek review, if so required, post amendment of the plaint, of the order which is CM(M) 209/2017

impugned by the petition at hand.

The petition and the pending application are dismissed as withdrawn with liberty as prayed, granted.
