This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Sole Arbitrator. 2.

Disputes having arisen between the parties with respect to Letter of Award dated 24.07.2015 issued in favour of the Petitioner by the Respondent for work of construction of one number of 275 M high reinforced concrete twin steel flue chimney, insulation, aviation, lighting and associated electrical and earthing systems all complete for chimney of Units 1 and 2 at 4x270 MW Bhadradri Thermal Power Station, Manuguru, Telangana, which contract was terminated by the Respondent on 22.03.2018, parties were referred to MSME Council under Section 18(1) of the Micro, Small and Medium Enterprises Development Act, 2006. Arbitration Centre ('DIAC') and a Sole Arbitrator was appointed. 3.

It is stated that mandate of the learned Arbitrator was extended from time to time and lastly vide order dated 30.04.2025 OMP (MISC) (COMM) 341/2025, which mandate has expired on 30.07.2025. It is stated that written submissions have been filed by the parties and arguments are being addressed for some clarifications. In this light, further extension is sought by 02 months to enable the learned Arbitrator to publish and pronounce the award.

Mr. Surjendu Sankar Das, learned counsel for the Respondent accepts notice and on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator. 6.

Accordingly, with the consent of the parties, mandate of the Arbitrator is extended by 02 months from 11.08.2025 and period between 31.07.2025 and 10.08.2025 is regularised.

Petition is allowed and disposed of in the aforesaid terms.
