This petition is preferred on behalf of the Petitioner under Section 29A (4) and (5) of the Arbitration and Conciliation Act, 1996 ('1996 Act') seeking extension of the mandate of the Arbitrator. 2.

Disputes having arisen between the parties in relation to the work of Widening of Merauli-Mahipalpur Road from 4 lanes to 8 lanes and service road from Andheria Mor to Masoordpur Village, Petitioner filed a petition in this Court under Section 11(6) of 1996 Act, seeking appointment of a Sole Arbitrator. On account of the demise of the learned Arbitrator, substitute Arbitrator was appointed vide order dated 13.09.2021. It is stated in the petition that arbitral proceedings are at the stage of Respondent's arguments. Mandate of the Arbitrator was extended from time to time and lastly vide order dated 09.08.2024 in OMP (MISC) (COMM) 589/2024 by one year from 13.08.2024.

Issue notice.

Mr. Lalltaksh Joshi, learned counsel for the Respondent accepts notice and on instructions, submits that the Respondent has no objection to the extension of mandate of the learned Arbitrator. 5.

Accordingly, with the consent of the parties, mandate of the Arbitrator is extended by a period of 06 months from 13.08.2025. 6.

Petition is allowed and disposed of in the aforesaid terms.
