The present appeal has been preferred by the appellant/Stateseeking enhancement of the sentence imposed upon the respondents vide order on sentence dated 02.11.2015passed by the learned Special Judge-07 (Central), (PC Act Cases of ACB, GNCTD), Delhi in CC No. 04/2012, whereby therespondents herein weresentenced to undergo RI for a period of 2years alongwith fine of Rs.5,000/- each,in default whereof they would undergo SI for 3 months each, for the offence punishable under Section 120B IPC.Both the convicts were further sentenced to undergo RI for a period of 2 years alongwith fine of Rs.10,000/- each, in default whereof they would undergo SI for 3 months each, for the offences punishable under Sections 420/120B IPC. They were also sentenced to undergo RI for 2 years alongwith fine of Rs.

5000/- each,in default whereof they would undergo SI for 3 months each, for the offences punishable under Sections 13(1)(d)/13(2) of the Prevention The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

of Corruption Act. All the sentences imposed upon each convict were directed to run concurrently inter se, and both convicts were accorded thebenefit underSection 428 Cr.P.C.

The cause list indicates that respondent no. 1/Pankaj Goelhad preferred a criminal appeal bearing CRL.A. No. 1202/2015 and respondent no. 2/C.B. Singhhad preferred a criminal appeal bearing CRL.A. No. 1241/2015,both of which have since been disposed of, vide judgment dated 15.04.2024 and order dated 26.09.2024 respectively. Copies of the said judgment and order are handed over in Court and the same are taken on record.

Vide the respective judgment and order, Co-ordinate Benches of this Court set aside the convictions of the respondents herein, and they thus stand acquitted.

Considering the aforesaid, the present State appeal seeking enhancement of sentence has becomeinfructuous and the same is disposed of accordingly.
