This is the third application filed on behalf of the applicant under Section 439 Cr.P.C. seeking grant of regular bail in case FIR No.173/2018 dated 06.03.2018 under Sections 498A/406/304(B)/34 IPC registered at PS: New Usmanpur.

On 16.08.2023, applicant had withdrawn the bail application being BAIL APPLN. No.839/2023 with liberty to approach the Trial Court. 3.

Learned counsel for the applicant fairly concedes that he did not approach the Trial Court and filed the present application. 4.

At this stage, liberty is sought to withdraw the application and file a fresh application before the Trial Court.
