The Petition under Section 439 CrPC has been filed on behalf of the petitioner seeking grant of Regular Bail in FIR No. 0621/23 dated 02.07.2023 under Sections 376/506 IPC registered at Police Station Bawana. 2.
It is submitted that the accused is in Judicial Custody since 20.07.2023 and has been implicated falsely in this case. It is further submitted that the petitioner and the complainant were in consensal relationship and that the petitioner had informed the complainant about being married.

The respondent is present in person and submits that the petitioner had failed to disclose about his prior marriage. 4.

Considering the submissions, learned counsel for the petitioner seeks permission to withdraw the Petition with liberty to file it afresh, subsequently. In view of the submissions made, the Petition is permitted to be withdrawn with liberty to file it after the recording of the statement of the complainant.

Considering that the accused is in Judicial custody for about one year, the learned Trial Court is hereby requested to frame the Charge and record the statement of the complainant preferably within three months. 7.
The Petition is accordingly disposed of.
