Petitioner is defendant before the learned Trial Court and is aggrieved by order dated 10.07.2023 whereby conditional leave to defend was granted to him with direction to deposit a sum of Rs. 1 lac before the learned Trial Court.

However, Mr. Amit Rao, learned counsel for petitioner submits that since suit, as such, has been dismissed-in-default, the present petition has become infructuous and, therefore, he does not press the same at the moment. He, however, submits that if aforesaid suit is restored, he may also be granted liberty to revive the present petition.

In view of the above, present petition is disposed of as having become infructuous. However, in case the suit is restored, petitioner would be at liberty to revive the present petition.
