BAIL APPLN. 3125/2024 1.

An application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for grant of interim bail for a period of 45 days on medical grounds in FIR No. 334/2019 under Section 302 IPC and 25/27 Arms Act registered at P.S.: Nand Nagri. Sections 212/201/120B/34 IPC and 54/59 Arms Act were subsequently invoked by the prosecution.

Learned APP for the State appears on advance notice and submits that petitioner is involved in a double murder case and the case is at the stage of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. prosecution evidence. He further submits that perusal of the impugned order reflects that accused can be conservatively treated at Jail since it is a case of Anaemia alongwith other ailments. It is also pointed out that learned Trial Court has duly taken care of the said fact and has further directed the Superintendent, Jail to file medical report of the petitioner before the learned Trial Court after every 15 days. Further, medical condition can be considered by the learned Trial Court in the light of subsequent reports. 3.

On the other hand, learned counsel for petitioner presses for interim bail.

Considering the medical status report on record and the fact that learned Trial Court has directed Superintendent Jail to file medical reports fortnightly, no grounds for interim bail are made out. However, Superintendent Jail is directed to get the petitioner examined at G. B. Pant Hospital from the concerned specialist Doctor(s), to ensure that necessary medical treatment is provided to the petitioner, in accordance with Jail Rules.

Petition is accordingly disposed of.
