Respondent no. 2 had filed a civil suit seeking injunction in the year 2019. Petitioner herein, besides filing written statement, also lodged a counter-claim, seeking compensation etc.

Prayer in the present petition is limited to the effect that learned Trial Court may be requested to dispose of the counter-claim and the suit within three months from today.

This Court does not have the benefit of going through all the orders passed by the learned Trial Court from time to time, though copies of some orders have been annexed with the present petition. 4.

learned Trial Court, there cannot be any automatic direction to dispose of the case within three months.

Present petition is, therefore, dismissed.

Needless to say, petitioner would be at liberty to move appropriate application before the learned Trial Court requesting the learned Trial Court to take up the matter on urgent basis and the petitioner would also be at liberty to make request before the learned Trial Court to direct that no unnecessary adjournments are sought from the opposite side. It will be upto the learned Trial Court to consider any such request, keeping in mind its own board and pendency.
