The petitioner/husband is seeking initiation of contempt proceedings against the respondent for alleged wilful disobedience of the order dated 05.09.2023 and subsequent orders passed in Guardianship Petition No.33/2022 by learned Judge, Family Court, Central District.

None is present for the respondent despite sending advance notice.

It is stated that the matter is coming up for hearing before the Family Court on 27.09.2024.

This Court is of a consistent opinion that the learned Judge, Family Court has ample powers at its hand to issue appropriate directions including coercive measures to ensure compliance of its orders. In case the orders are not complied with, the respondent may be also imposed with financial penalty or even attachment of their assets. Besides, there are other measures in law that may be invoked in order to enforce the directions of the Court. 7.

The present Contempt Petition is disposed of with directions to the learned Judge, Family Court to exercise his discretionary powers in such a manner to ensure that its directions are enforcement in an effective and timely manner. This order is passed without prejudice to the rights and contentions of the parties.
