Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of petitioner for quashing of order dated 24.05.2023 whereby the petitioner Prakash Veer Yadav was declared as absconder.

Learned counsel for respondent appears on advance notice and submits that petitioner was declared as absconder since he intentionally failed to appear despite having joined proceedings earlier and does not call for any leniency since FIR was directed to be registered in accordance with law in 2023 vide impugned order.

Apparently, petitioner intentionally failed to appear in the proceedings before learned Trial Court. No grounds are made to interfere in the impugned order as no irregularity has been pointed out. 4.

At this stage, learned counsel for petitioner seeks to withdraw the petition.
