The present suit has been filed seeking a declaration that the plaintiff is true, legal and lawful owner of the property. However, on a perusal of the plaint and the documents annexed therewith, it is not evident that on what basis the plaintiff seeks the declaration of ownership. 2.

After some arguments, learned counsel for the plaintiff states on instructions that he seeks permission to withdraw the present suit, with liberty to avail appropriate remedy, in accordance with law. 3.

The suit alongwith applications is dismissed as withdrawn with liberty reserved.
