The present suit has been filed for seeking partition of the immovable properties forming part of the estate of Sunder Singh Aneja ('HUF') and the estate of late Rajinder Kaur Aneja. It is a matter of record that the suit properties enlisted at Clauses (ii) to (xx) are located in the State of Uttar Pradesh.

Learned counsel for the plaintiffs' states on instruction from the plaintiffs that he seeks permission to withdraw the present suit with liberty to approach the Court of appropriate jurisdiction, in accordance with law. He states that he seeks liberty in view of the fact that the immovable estate is substantially located in the state of Uttar Pradesh and many of the parties are residing in Uttar Pradesh.

The suit is, accordingly, permitted to be withdrawn with liberty to the plaintiffs to approach the Court of appropriate jurisdiction in accordance with law.
