After making brief submissions, Mr. Puneet Mittal, learned Senior Counsel assisted by Mr. Atul Jain appearing for the petitioner, seeks liberty to withdraw instant writ petition with further liberty to make a proper representation supported by necessary documents to the respondent-DoE requesting for modification of the conditions stipulated in letter dated 07.10.1997 in a time-bound manner.

The aforesaid submission seems to be reasonable keeping in mind the fact that from 2011-12 to 2019-2020, the petitioner had granted admission in Nursery against the seat allocated by the respondent-DoE itself and the reimbursement to the said seats had already been granted up till 2019-20. At this stage, without expressing any opinion on the merits of the case or otherwise, the Court grants liberty to the petitioner to withdraw the instant writ petition and to file a proper representation to the respondent. If the representation so made to the respondent, let the due opportunity of hearing to the petitioner shall be accorded and the representation shall be considered with due expedition not beyond six weeks from the date of receipt of the said representation.

Needless to state that, if the representation is decided against the petitioner, then the petitioner shall be at liberty to take necessary recourse in accordance with law.
