The present petition is filed challenging the order dated 02.12.2023 (hereafter 'impugned order'), passed by the learned Additional Sessions Judge ('ASJ'), in CA No. 260/2022. An application was filed by the petitioner in the pending appeal seeking proper inquiry to be conducted and to appoint a bailiff for verification of the address of the respondent which was dismissed by the impugned order.

The learned ASJ in the impugned order noted that an affidavit disclosing fresh address has been filed by the respondent. The learned ASJ further noted that the petitioner is not ready to address the arguments in the appeal filed by him. The learned ASJ has granted the petitioner a final opportunity to address his arguments and has fixed the matter for hearing on 23.02.2024. The order granting opportunity to address arguments and adjourning the matter is not revisable under Section 397 of Code of Criminal Procedure, 1973. From the conduct it is apparent that the petitioner, after having obtained the interim order from the learned ASJ, is trying to delay the proceedings.

In view of above the present petition is dismissed with cost of Rs.10,000/- (Rupees Ten Thousand) to be paid to the Delhi The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
