On the last date of hearing, it was submitted by learned counsel for the petitioner that petitioner is ready to vacate the tenanted premises if reasonable time is given to him.

Learned counsel for the respondent has agreed to give one year time with effect from 5th May, 2017 to the petitioner to vacate the suit property with the condition that for a period of one year the petitioner would continue paying the admitted rent, water and electricity charges but if she fails to vacate on expiry of period of one year she would be liable to pay the double rent with effect from 5th May, 2017.

Thereafter, at the request of learned counsel for the petitioner to file the undertaking of the petitioner to the above effect, the matter was adjourned for today.

Today learned counsel for the petitioner submits that he could not furnish the undertaking due to the ill health of the petitioner. However, he seeks one week time to file the undertaking.

Learned counsel for the respondent submits that the petition may be disposed of giving one week time to the petitioner to file the undertaking with direction to abide by the same.

In view of the above, learned counsel for the petitioner is directed to file the undertaking of the petitioner within a week with the Registry. 7.

In view of the settlement between the parties conditions of which shall be incorporated in the undertaking to be furnished by the petitioner, the petition is disposed of. Petitioner shall be bound by the terms of undertaking to be furnished with the Registry.

The petition stands disposed of.
