Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 read with Article 226 of Constitution of India has been filed seeking quashing of FIR No. 0388/2024 dated 15.03.2024 registered under Sections 363/376(2)(N) IPC and Section 6 POCSO Act at P.S. Nihal Vihar. 2.
It is submitted that though the parties have got married in Arya Samaj Mandir but they both belong to separate religions and intend to get married under Special Marriage Act.

In view of the above, learned Counsel for the Petitioner seeks permission to withdraw the present Petition to file it afresh after they get married under the Special Marriage Act.
