Mr. Durgesh Gupta, learned counsel for the petitioner, states that the prayer clause of this petition is incorrect as the petitioner, in fact, seeks appointment of a substitute arbitrator to proceed with the arbitration proceedings after termination of the proceedings by the order of the learned arbitrator dated 09.04.2018.

In view of the fact that more than five years have lapsed since the aforesaid order, prior to filing of the present petition, Mr. Gupta seeks permission to withdraw the petition with liberty to take alternative remedies. 3.
The petition, alongwith pending applications, is dismissed as withdrawn with liberty as aforesaid.
