This Transfer Petition seeks transfer of RCA 39/2016 (Sushil Kumar Jain and Ors. v. Ajay Kumar Jain and Anr.) presently pending before the learned Additional District Judge-01, Karkardooma Court to the competent Court in the North-East District, Karkardooma Court, Delhi, which, it is submitted, is the jurisdictionally competent Court.

Learned Counsel for the respondents does not dispute this position or oppose the request for transfer. He, however, submits that this matter has been prolonged owing to a number of adjournments which have been taken in the case.

It would be open to the respondents to urge this plea before the transferee Court.

Accordingly, RCA 39/2016 (Sushil Kumar Jain and Ors. v. KUMAR 16:47:57 TR.P.(C.) 205/2023

Ajay Kumar Jain and Anr.), presently pending before the learned Additional District Judge-01, Karkardooma Court stands transferred to the competent Court in the North-East District, Karkardooma Court, Delhi.

The Registry of the Karkardooma Court is directed to take expeditious steps to transmit the records to the transferee Court. 6.

Accordingly, the Transfer Petition stands disposed of. 7.

Renotify before the transferee Court on 7 March 2024, the date already fixed.
