This hearing has been conducted through hybrid mode. 2.

In the present petition, the petitioner has prayed that the action of the respondent no. 2/Reserve Bank of India ('RBI') regarding declaration of the petitioner as a 'wilful defaulter' be set aside. 3.

The respondent no. 3/Yes Bank Ltd. has filed an affidavit and the relevant para of the same reads as under:

"f. That pursuant to the issuance of the 'No Dues Certificate,' Respondent No. 3 has stopped the flagging or reporting of any financial defaults to RBI concerning SSLJ or its members of the governing body, NHRNCRPL or its respective directors or key managerial personnel, including the Petitioner herein. It is also pertinent to mention that the Petitioner's name was last reported by Respondent No. 3 to the CIC (Credit Information Company) in the financial year 2022, and there has been no subsequent reporting of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. any defaults or irregularities in this regard after the entities settled their accounts with the Respondent No.

3. A copy of the screenshot from Trans Union CIBIL's defaulter's portal, which shows the year 2022 as the date of reporting from Respondent No. 3 is annexed herewith and marked as 'Annexure A-1'."

The respondent no. 2/ RBI has filed an affidavit and the relevant para of the same reads as under:

"4. I say that the present affidavit is being -filed in compliance of the aforesaid directions and confirm that the Reserve Bank has received confirmation from Yes Bank that the Petitioner has not been declared a willful defaulter by the bank."

Learned counsel for the respondent no. 3/Yes Bank Ltd. submits that as per the affidavit of respondent no. 3/YES Bank Ltd. there is no fresh reporting of the petitioner as a wilful defaulter in the records of the RBI. 6.

Learned counsel for respondent no. 2/RBI on the basis of the affidavit submits that RBI has received confirmation from Yes Bank Ltd. that the petitioner has not been declared a wilful defaulter. 7.

Learned counsel for the petitioner submits that keeping in view the submissions made by the learned counsels appearing on behalf of the respondents as well as the affidavits placed on record, the petitioner is not interested in pursuing the present petition and it may be disposed of as withdrawn.

Accordingly, the present petition is disposed of as withdrawn. Pending application(s), if any, also stand disposed of.
