The present petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking the following reliefs:- "a. It is, therefore, respectfully prayed that a Writ Petition in the nature of HABEAS CORPUS may kindly be issued thereby directing respondent No.2 and 3 to provide adequate and Produce the daughter of the Respondent no. 4 namely Pallavi and may kindly be directed not to take any action on the false complaints of the family members of the petitioner and the daughter of the Respondent no. 4 namely Pallavi as the petitioner and the daughter of the Respondent no. 4 namely Pallavi are legally wedded husband and wife having performed the marriage with their own sweet will and consent and for this kindact of your lordship the petitioner shall always remain obliged and grateful.

b. Issue direction to the respondent no. 4 to 7 to hand over the physical custody of the daughter of the Respondent no.4 namely Pallavi to the petitioner immediately and unconditionally as they are legally wedded husband and wife;

c. Issue direction to the respondent no. 4 to 7 to restrain from creating any kind of nuisance or hindrances in the peaceful marital life of the petitioner and the daughter of the Respondent no. 4 namely Pallavi."

Ms. Pallavi, has joined the proceedings today through Video Conferencing. She states that she is aged about 19 years and is 10th Class Pass. She submits that, presently, she is residing with her parents i.e. at her parental home and has no desire to live with her husband, namely, Mr. Lovneesh Kumar, any more.

In view of the abovesaid, learned counsel for the petitioner, on instructions, seeks permission to withdraw the present petition, with liberty to take recourse to other remedies available under law. 4.

Permission and liberty, as prayed for, in accordance with law, is granted.

Accordingly, the present petition is dismissed as withdrawn.
