The present application has been filed under Order XXIII Rule 1 of the Code of Civil Procedure, 1908, seeking to withdraw the present suit on account of a settlement arrived at between the parties. 2.

For the reasons stated, the application is allowed. The suit is dismissed as withdrawn.

Since the matter has been settled at an early stage, the Registry is directed to refund 50% of the Court Fees in favour of the plaintiff in terms of Section 16-A of the Court Fees Act, 1870.
