As per office note, counter to the above captioned petitioner has been filed on behalf of respondent no. 1. 2.

Respondent no. 2 has not filed any counter to the above captioned petition despite service through e-mail dated 05.10.2025 and courier on 17.10.2025.

By way of the above captioned petition, the applicant seeks summoning of respondent no. 2 with directions to produce the original invoices as identified in the ledger annexed with the petition for evidence before the learned Arbitrator on the date already fixed i.e. 13.02.2026.

the ground that there is no agreement between the petitioner and respondent no. 2 and as such, respondent no. 2 i.e. Amazon Web Services India Pvt. Ltd. (AWSIPL) not be bound by the agreement between the petitioner and respondent no. 1 in any manner.

On the other hand, learned counsel for the petitioner submits that the dispute revolves around the genuineness of the invoices raised by the respondent no. 1 and thus, prayed that the witness mentioned in the above captioned petition be summoned along with the requisite records before the learned Arbitrator for evidence.

Submissions heard. Petition perused.

In view of the submissions, the above captioned petition is hereby allowed. Let, the witness i.e. respondent no. 2 be summoned, with directions to produce the original invoices, as identified in the ledger annexed along with the petition, on filing of the requisite Process Fee by the petitioner within two days, with directions to appear before the learned Arbitrator on the date already fixed before the learned Arbitrator i.e. 13.02.2026. It is clarified that the diet money of the witness shall be borne by the petitioner and be payable at the spot.

The above captioned petition stands disposed of accordingly.
