$~43 * IN THE HIGH COURT OF DELHI AT NEW DELHI + CONT.CAS(C) 146/2017 & C.M.No.6575/2017 KRISHNA KALRA AND ANR ..... Petitioners Through Mr.Sagar Dawar, Advocate.
versus MOHAN JEET SINGH AND ORS ..... Respondents Through Mr.Ajjay Aroraa with Mr.Kapil Dutta, Advocates for EDMC.
CORAM:
HON'BLE MR. JUSTICE MANMOHAN
O R D E R
% 20.02.2017 Present contempt petition has been filed alleging wilful disobedience of the order dated 20th May, 2016 passed in W.P.(C) No.4043/2016, whereby the respondents were directed to grant an opportunity of hearing to the petitioners before passing any order on the basis of advisories issued by the Public Grievance Committee. Learned counsel for the petitioners states that despite the aforesaid order, the respondents have passed an order/direction dated 30th January, 2017 without affording an opportunity of hearing to the petitioners.
A perusal of the paper book reveals that it is the case of the respondents that enough opportunities to file reply/response had been given to the petitioners.
Consequently, even though, it is the case of the petitioners that despite written request, requisite documents and personal hearing had
not been given to the petitioners, yet this Court is of the view that as it is the respondents' case that enough opportunities to state their case in writing had been given, the present contempt petition is not maintainable. Accordingly, the same is dismissed. However, the petitioners are given liberty to challenge the impugned order dated 30th January, 2017 in accordance with law. The rights and contentions of all the parties are left open. Order dasti.
