% 12.01.2016 Learned counsel for the respondents has brought to court eight cheques amounting in all to a sum of Rs. 21,03,627/-. Out of the eight cheques, seven cheques are valued at Rs. 2.70 lacs each, while the eighth cheque is valued at a sum of Rs. 2,13,627/-.
The said cheques have been handed over to the counsel for the petitioner. Learned counsel for the petitioner says that if these cheques are honoured, then the petition will stand satisfied. In these circumstances, the petition is disposed of with a direction to the Managing Director of the respondent company to file an affidavit in this court within three days from today. The affidavit will state that the cheques handed over in court today to the counsel for the petitioner shall be honoured on their respective due date set out therein. In any event, learned counsel for the respondents has undertaken on behalf of the respondents that the cheques will be honoured on the due date. CO.PET. 228/2014
It is made clear, in case there is a default, the petitioner will be at liberty to revive the petition. No further orders are called for, for the time being.
