The learned Additional Public Prosecutor for the State at the outset submits that proceeding under Section 82 of the Code of Criminal Procedure, 1973 (CrPC) have already been initiated against the applicant and in such circumstances, the present application is not maintainable.

Considering the above, the learned counsel for the applicant seeks liberty to withdraw the present application and file appropriate petition challenging the proceeding initiated under Section 82 of the CrPC.
