% 14.11.2024 1.
This is a petition filed under section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 („BNSS‟) seeking quashing of FIR No. 547/2020 dated 16.06.2020 under section 313 of IPC registered at Police Station - Uttam Nagar, New Delhi and proceedings emanating therefrom. 2.
It is stated that the aforesaid FIR was registered in a heat of the moment and based on misunderstanding.
3.
The petitioner and respondent No. 2 are husband and wife and are living together happily. Both the petitioner and respondent No. 2 are present in Court and have been identified by their counsel respective counsels. 4.
It is submitted that the parties have arrived at settlement dated 05.08.2024. Both the parties state that they have entered into the aforesaid settlement out of their own free will, volition and without any threat, force, undue influence or coercion.
5.
The respondent No. 2 states that she does not wish to prosecute the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 20/11/2024 at 12:31:18
aforesaid FIR any further and the same may be quashed. 6.
I am satisfied that the matter has been settled and the settlement is lawful. Since the parties have arrived at a settlement and no disputes are pending, I am convinced that quashing of such proceedings on account of settlement would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further.
7.
In this view of the matter, there are no reasons to continue the proceedings. For the said reasons, the FIR No. 547/2020 dated 16.06.2020 under section 313 of IPC registered at Police Station - Uttam Nagar, New Delhi and the consequential proceedings emanating therefrom are hereby quashed.
8.
The petition is disposed of accordingly.
