By way of present petition, the petitioner seeks to assail the order dated 30.05.2023 vide which respondent No.2 was admitted to bail in FIR No.77/2023 registered under Sections 419/420/467/468/471/201/120B/34 IPC at P.S. Special Cell, Delhi.

The petitioner, who is the complainant in the aforesaid FIR, thereafter challenged the aforesaid order granting bail vide application under Section 439(2) Cr.P.C. before the same Court on the ground that the offence was serious and looking into gravity of the allegations, the bail ought not have been granted, which came to be dismissed vide order dated 05.02.2024. 3.

By way of present petition, the petitioner claims that post grant of bail, brother of respondent No.2 has approached the petitioner for settling the matter and thus violated the bail conditions. Pertinently, though the petitioner ought to have approached the same court for cancellation of bail but in view of the fact that the petitioner has already approached the Sessions Court, the present petition is taken up for consideration. Alongwith the petition, a copy of the transcript has been placed on record. Learned counsel has referred to the portion of the transcript in which it is claimed that brother of respondent No.2 has approached the petitioner for settling the matter. 5.

Learned APP for the State submits that besides respondent No.2, there are other persons who are arrayed as accused in the aforesaid FIR and the petitioner has settled his claim against 4 of them. 6.

On a reading of the entire transcript, I find no ground to entertain the present petition. Accordingly, the same is dismissed alongwith the pending application.
