The present suit has been filed with respect to the immovable estate of late Sh. Mohan Lal Oberoi. However, a perusal of the plaint and the record of this Court shows that the suit with respect to the immovable estate of late Sh. Mohan Lal Oberoi was filed before this Court and numbered as CS(OS) 3443/2015. A preliminary decree with respect to his estate was also passed therein on 14.02.2023, which was upheld by the Division Bench in RFA(OS) 5/2023 and attained finality. The plaintiff herein was also appearing in the said suit. The present suit filed yet again for the same immovable estate of late Sh. Mohan Lal Oberoi is therefore not maintainable.

Learned counsel for the plaintiff states on instructions that he seeks liberty to withdraw the present suit to avail his remedy by filing appropriate proceedings, in accordance with law.
