The present petition under Article 227 of the Constitution of India, 1950, seeks following prayers:- "(i) Set aside the impugned order dated 26/04/2024 passed by Labour Commissioner Ashok Vihar, Delhi in the matter Ramesh Chand Vs Anil Jindal &Anr. bearing no. ECD/113/NW/2021/1084- 88. (iii) Any other relief(s) which this Hon'ble court may deem fit and proper."

None appears on behalf of the petitioner today. 4.
There has been no appearance on behalf of the petitioner on the previous two dates of hearing, i.e., 10.10.2025 and 28.11.2025, before the learned Registrar as well.

Vide order dated 30.07.2025, this Court had passed the following order:- "1. This hearing has been done through hybrid mode. CM APPL. 26199/2025
2. Notice was issued to the petitioner and as per the report the same has been served on the petitioner.
3. None appears on behalf of the petitioner.
4. There is no appearance on behalf of the petitioner on the previous date of hearing, i.e., 01.05.2025.
5. Learned counsel appearing on behalf of the respondents/applicants submits that recovery proceedings are pending.
6. Vide order dated 21.11.2024 passed by this Court it was made clear that in case the amount under execution is not deposited there shall be no protection and the award shall be executed in accordance with law.
7. The competent authority shall proceed in accordance with law with respect to the execution of award.
8. List on 04.12.2025.
9. It is made clear that there is no stay with respect to the recovery proceedings initiated with respect to the petitioner." 6.
In view of the above, the present petition is dismissed in default for non-prosecution and disposed of accordingly.
