% 04.05.2016 I.A. No. 5555/2016 This application has been filed by the defendants to seek transfer of the suit in terms of the notification issued by the Chief Justice. It is pointed out that the valuation of the suit is Rs.1,44,20,000/-. The plaintiff has sought specific performance of the agreement in respect of the residential property. Therefore, the dispute is not a commercial dispute. The plaintiff has been served with an advance copy. However, none appears for the plaintiff.

In view of the notification No.2718/DHC/Orgl. dated 25.11.2015, issued under Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), the present suit is transferred to the Court of the District Judge (West), Tis Hazari Courts, Delhi for further proceedings before the competent court on 18.07.2016. The Court concerned shall proceed after notice to the plaintiff.
