Heard the learned counsel for the parties.

By instituting the proceedings of this petition under Article 226 of the Constitution of India, a prayer has been made for issuing an appropriate direction to the respondents to immediately seal/remove and demolish all unauthorized tin/temporary shops which have sprung up on the public passage way and land under/abutting AIIMS Delhi Metro Station and adjacent running highway.

Before approaching this Court with the aforesaid prayer, the petitioner has not approached the authority concerned which is entrusted to take appropriate measures in case any unauthorized shop on public passage is raised.

In view of the aforesaid, we permit the petitioner to approach the authority concerned for redressal of his grievances by way of making a detailed representation taking all the pleas which may be available to him and enclosing therein all the documents on which he intends to rely. The said representation shall be made within a fortnight from today. Once any such representation is made, the same shall be attended to and appropriate decision and action which may be warranted under law shall also be taken with expedition.

The writ petition thus stands disposed of in the aforesaid terms.
