The petitioner assails order dated 01.04.2024 of the learned trial Magistrate whereby petitioner was summoned to face trial under Section 138 NI Act.

After addressing partly, learned counsel for petitioner seeks permission to withdraw this petition so that petitioner may appear before the trial court and face trial.

However, learned counsel for petitioner submits that the petitioner, a resident of Chennai apprehends threat to his life and limb at the hands of respondent no. 2, so he may be granted exemption from personal appearance. The submission in this regard is fair, but it would be appropriate for petitioner to move appropriate application in the trial proceedings. 4.

As requested, the petition and the accompanying applications are dismissed as withdrawn.
