This is a writ petition seeking quashing of FIR No. 433/2009, under Sections 302/34 IPC, registered at Police Station Anand Vihar, along with supplementary charge sheet filed on 28.04.2024 against the present petitioners.

incident took place in the year 2009 and supplementary charge sheet qua the present petitioners has been filed in the year 2024. He submits that petitioners are not named in the FIR and have not been identified in Test Identification Parade. No recovery has been effected from the present petitioners. Thus, that being so, there is no evidence against the present petitioners.

Mr. Sanjeev Bhandari, learned ASC appearing on behalf of State, submits that petitioners could not be arrested and were absconding. After their arrest, the supplementary charge sheet was filed in the year 2024. On merits also, he contests the claim of learned counsel appearing for the petitioners and further states that the matter is listed for consideration of charge before the learned trial Court on 20.08.2025. 4.
After part submissions, learned counsel appearing for the petitioners seeks permission to withdraw the present petition with liberty to urge all his submissions before the trial Court at the stage of charge. 5.
The statement made by learned counsel is taken on record and petition is dismissed as withdrawn. All rights and contention of both parties are kept reserved.
