% 06.02.2024 I.A. 2343/2024 (under Order XXIII Rule 3 read with Section 151 of CPC) 1.

This is a joint application on behalf of the parties for disposal of the suit on consent terms.

Counsel for the parties have presented a Settlement Agreement dated 18th December, 2023, which has been placed in a sealed cover. They confirm that the Settlement Agreement shown to the Court and the one placed in sealed cover are identical.

Both counsel draw attention of the Court to a term contained in the Settlement Agreement, wherein parties have agreed to keep the terms of settlement confidential and not disclose the same to any third party. 4.

The Court has perused the terms of the aforenoted Settlement Agreement, and finds the same to be lawful. respective counsel. The application is also duly supported by affidavits of the Authorized Representatives of the parties. Signatures of the parties have been identified by the counsel present in Court, who confirm the settlement and pray that the suit be decreed in terms thereof. 5.

It is clarified that in case such a situation arises wherein the Settlement Agreement is required to be enforced as a decree of the Court, then the claimed confidentiality shall cease to apply. 6.

In view of the above, the instant application is allowed and disposed of.

In light of the order passed in I.A. 2343/2024, and considering the fact that a settlement has been arrived at between the parties, the suit is decreed in favour of the Plaintiffs, and the counter-claim is decreed in favour of the Defendants, in terms of Settlement Agreement dated 18th December, 2023. The parties shall remain bound by the terms of the Settlement Agreement. 8.

Parties shall file the Settlement Agreement in a sealed cover with the Registry within a period of one week from today. 9.

The decree sheet shall not reproduce or disclose the terms of the Settlement Agreement other than the date on which it has been executed, i.e., 22nd January, 2024.

Decree sheet be drawn up.

File be consigned to record room.
