% 22.04.2016 The disputes between the plaintiff and the defendant No.2 were referred to mediation. The plaintiff and the defendant No.2 have arrived at a settlement contained in the settlement agreement dated 21.04.2016, duly signed by the said parties, their counsel and the learned Mediator. Under the settlement, the plaintiff has agreed to give up her claim against defendants No.1 & 3 and to delete them as defendants. Accordingly, they stand deleted from the array of defendants. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same.
The cheques in terms of the said settlement have been delivered by defendant No.2 to the plaintiff. Learned counsel for the defendant submits that the said cheques shall be honoured upon presentation as per the schedule mentioned in the settlement. The plaintiff and the defendant No.2 shall remain bound by the said settlement.
