By virtue of the present petition filed under Section 24 of the Code of Civil Procedure, 1908, the petitioner seeks transfer of divorce petition being HMA no.2667/2019 under Sections 13(1)(ia) and 13(1)(ib) of the Hindu Marriage Act, 1955, pending before the Court of learned Principal judge, Family Court, Dwarka, Delhi to the Court of the learned Principal judge, Family Court, Saket, district- South- East, Delhi. 2.

Considering the nature of the proceedings inter-se the parties involved, wherein only a singular proceeding being HMA no.2667/2019 under Sections 13(1)(ia) and 13(1)(ib) of the Hindu Marriage Act, 1955 has been filed by the husband/ respondent against the wife/ petitioner before the Principal Judge, Family Court, Dwarka, New Delhi, and pertinently as many as six other proceedings being Court Case The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. no.623935/2016, Cr. Case no. 94959/2016, Ex Crl. No. 316/2018, Ex Crl. No.274/2019, Ex Crl. No. 195/2020, Ex Crl. No. 310/2023 has been filed by the wife/ petitioner against the husband/ respondent before the Saket Courts.

For the reasons stated, and considering the nature of the disputes involved, especially since the dispute is pertaining to the wife/ petitioner and husband/ respondent, in my opinion, there is no requirement of issuance of notice, and the same can be dispensed with. 4.

As such, the present petition is allowed and the HMA no.2667/2019 filed by the husband/ respondent against the wife/ petitioner before the learned Principal Judge, Family Court, Dwarka, New Delhi, is withdrawn and assigned to the Court of the learned Principal judge, Family Court, Saket, South-East district, Delhi.

In these circumstances the Learned Principal Judge, Family Court, Dwarka, New Delhi is directed to send the entire record of the present case to Learned Principal judge, Family Court, Saket, South-East district, Delhi.

Accordingly, in view of the aforesaid, the present petition is allowed and stands disposed of.

A copy of the present order be sent to the Court of the Learned Principal judge, Family Court, Saket, South-East district, Delhi and Learned Principal Judge, Family Court, Dwarka for information and compliance.
