The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter "BNSS") has been filed by the petitioner praying for quashing of FIR bearing No. 322/2024 registered at Police Station Bara Hindu Rao, Delhi, for offences punishable under Section 110 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter "BNS"). 4.

violence. The petitioner was arrested in connection with said FIR on 30.07.2024, and the learned Sessions Court granted the bail to the petitioner vide order dated 08.08.2024.

It is submitted by learned counsel from the petitioner that the injuries suffered by the respondent no. 2 are simple in nature and the petitioner and respondent no. 2 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 6.

Compromise deed dated 29.10.2024 is on record and has been annexed as Annexure P-3 to the present petition. Through this deed, the respondent no. 2 has agreed to withdraw the case arising out of FIR bearing No. 322/2024 registered at Police Station Bara Hindu Rao, Delhi, against the petitioner.

It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise arrived between them.

Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioner seeking quashing of the FIR in question in view of the settlement arrived at between the parties.

Heard learned counsel for the parties and perused the record. 10.

The petitioneris present before this Court and has been identified by his counsel Mr. Anuj Soni and Investigating OfficerASI Parveen Kumar and ASI Ram Kumar, Police Station Bara Hindu Rao, Delhi. Respondent no. 2 is also present in the Court and has been identified by the Investigating Officer.

On a query made by this Court, respondent no. 2 has categorically stated that he has enteredinto the compromise on his own free will and without any pressure. It is also stated by him that the entire dispute has been amicably settled between the parties.

While allegations pertaining to Section 110 BNS are often consequential, a perusal of the FIR, MLC, and Chargesheet which are annexed to the present petition reveals that the injuries inflicted upon the victim were simple and non-serious in nature, and that the parties are neighbours, living on different floors of the same building. Considering the nature of relationship shared, it is noteworthy that the parties seek to forgive one another and work towards a peaceful future. 13.

Keeping in view the fact that the matter stands amicably been settled between the petitioners and respondent no. 2 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 14.

Hence, in light of the judgment of the Hon'ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR bearing No. 322/2024 registered at Police Station Bara Hindu Rao, Delhi, for offences punishable under Section 110 of the BNS, and consequent proceedings emanating therefrom, are quashed.

The petition along with pending applications, if any, stands disposed of.
