In this suit for permanent injunction restraining infringement of trademark and trade name 'ST.IVES' of the plaintiff and for ancillary reliefs issues were framed as far back as on 21st October, 2009. 3.

The counsel for the defendant on enquiry states that no witness has been examined till now.

The order dated 3rd January, 2016 of the Joint Registrar records that the counsel for the plaintiff had stated that the plaintiff has not contacted him despite efforts. Inspite thereof, the Joint Registrar adjourned the recording of evidence to 3rd May, 2016.

However, on 3rd May, 2016, none appeared on behalf of the plaintiff. 6.

It is apparent that the plaintiff is not interested in pursuing the suit. 7.

Dismissed in default.
