After some arguments, learned counsel for the petitioner, on instructions, seeks leave to withdraw the present petition, however, prays that the trial be expedited which pertains to year 2015 in which only 21 witnesses were cited and out of 21, till date only 6 witnesses remain to be examined. He submits that the brother of the deceased namely Deepak Vishnu though was examined, however, he has not been appearing before the Trial Court resulting in delay of the trial. 2.

Learned APP fairly does not oppose the request of learned counsel for petitioner. He further submits that only one material witness, namely, Deepak Vishnu remains to be cross-examined and IO will take steps to ensure that the said witness will be summoned for cross-examination. further states that remaining witnesses are formal witnesses and they will also be examined at the earliest. Learned APP further submits that though the next date before Trial Court is 13.01.2025, however, the IO will take steps for preponing the date and make a request to prepone the date, summons the witness Deepak Vishnu and examine him at an earlier date. 3.

Considering the request made and no objection by learned APP, Trial Court is directed to make an endeavour to expedite the trial and conclude the same at the earliest.

The present petition is dismissed as withdrawn with the aforesaid directions.
