By way of present petition, the petitioner seeks quashing of FIR No. 714/2022 registered under Sections 174A IPC at P.S. Tilak Nagar, Delhi, pending before the learned Trial Court.

Mr. Bhalla, learned counsel for the petitioner submits that the underline proceedings under Section 138 N.I. Act have already been compounded and in so far as the present FIR is concerned, it is stated that in the aforesaid proceedings, it was placed on record that the petitioner/accused was a resident of Canada. He submits that no summons/warrants were ever received by the petitioner and remain unexecuted. 3.

Alongwith the petition, copy of order dated 30.07.2024 passed in C.C. No. 1405/2019 titled as Joginder Singh Banga vs. Amandeep Singh Gandhi is placed on record, a perusal of which shows that the offence under Section 138 N.I. The explanation offered by the petitioner is plausible and considering that the proceedings under Section 138 N.I. Act are already disposed of, no fruitful purpose will be served in continuance of the present criminal proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed. 5.

With the above directions, the petition is disposed of alongwith miscellaneous application.
